Buying a Used Car With a Loan Still Owing

A seller may still owe money on the vehicle you want to buy. That does not automatically prevent a sale, but it creates a process you need to verify with the lender and the relevant title authority. Do not build the transaction around an informal promise that the lien will disappear afterward.
Obtain current lender instructions
Ask the seller to arrange the information and authorization needed for a legitimate payoff process. Verify the lender’s contact details independently. A balance screenshot is not necessarily a dated payoff amount or an instruction for releasing the lien.
Separate price from payoff
The agreed purchase price and outstanding loan are different numbers. If the payoff exceeds the price, establish how the seller will fund the shortfall. If the price exceeds payoff, clarify how the remaining proceeds reach the seller. Put the amounts and responsibilities in writing.
Understand the title timing
Ask whether the title is electronic or physical, who holds it and which release documents are required. Processing arrangements vary. Confirm how you can lawfully register, insure and move the vehicle while any necessary documents are being completed.
Verify payment instructions
Use the lender’s confirmed process rather than an unverified account supplied in a last-minute message. Save receipts and confirmations. A seller’s urgency is not a reason to skip verification of where a substantial payment is going.
Pause if the process cannot be explained
For an unclear lien, multiple claimants or disputed ownership, seek appropriate professional or official guidance before paying. A discount does not resolve defective paperwork. Choose another vehicle if you cannot establish a credible route from payment to the ownership documents you need.
